Introduction
These are terms that will apply to your use of our Site Services.  You should read these terms thoroughly. Please note that these comments have no legal effect and are not part of our endorsed terms.

These “TOU” (Terms of Use) apply to your access and use of WePoll.Net's products, services, websites, and apps (if any) that sign up for or you purchase on WePoll.Net's website (collectively the “Service(s)”).

Supplementary service-specific terms apply to some Services (“Service-Specific Terms”). Certain country-specific terms may also apply to you if you are located outside INDIA(“ Your Country-Specific Terms”). We state the Service-Specific Terms and Country-Specific Terms collectively as “Additional Terms” and the combination of these Terms of Use and any applicable Additional Terms collectively referred to as “Terms.” To the extent any conflict exists, the Additional Terms overcome over these Terms of Use concerning the Services for which the Additional Terms apply. You agree to these Terms by clicking to accept these Terms (in applicable places of Website or Apps), executing a document that positions them, or using the Services.

1. Privacy
We know that by giving us your Content (as defined below), you are trusting us to treat it appropriately. WePoll.Net's Privacy Notice, together with any Service-specific privacy notices or statements (collectively, “WePoll.Net privacy notices”), detail how we consider your Content that is considered Personal Data and we agree to adhere to those WePoll.Net privacy notices. You in turn agree that WePoll.Net may use and share your Content under the WePoll.Net privacy notices and applicable Data Protection Regulations. You also agree that you are responsible for notifying your respondents, end users, and guests about the WePoll.Net privacy notices.

2. Confidentiality
WePoll.Net will treat your Content as Public and confidential (wherever applicable) information and only use and disclose it under these Terms (including the WePoll.Net privacy notices). However, your Content is not regarded as confidential information if such Content:
(1) is or becomes public (other than through a breach of these Terms by WePoll.Net);
(2) was lawfully known to WePoll.Net before receiving it from you;
(3) is received by WePoll.Net from a third party without knowledge of breach of any obligation owed to you; or
(4) was independently developed by WePoll.Net without reference to your Content. 

WePoll.Net may disclose your Content when required by law or legal process, but only after WePoll.Net, if permitted by law, uses commercially reasonable efforts to notify you to allow you to challenge the requirement to disclose.

If you sign up for a poll account with a work email address owned by an Enterprise and the Enterprise requests information about such accounts, we may or may not notify you before sharing your contact information and account usage information. If the Enterprise customer requests consolidation of all accounts created with a work email address owned by the Enterprise customer, your content will be combined under the Enterprise account.

3. Security
WePoll.Net will accumulate and process your Content in a manner consistent with industry security standards. WePoll.Net has implemented suitable technical, organizational, and administrative systems, policies, and procedures.

If WePoll.Net becomes aware of any unauthorized or unlawful access to, or acquisition, modification, use, disclosure, or destruction of, Personal Data, related to your account (“Security Incident”), WePoll.Net will take reasonable steps to notify you as soon as possible. Such announcement shall not be interpreted or construed as an admission of fault or obligation by WePoll.Net. 

A Security Incident does not include unsuccessful attempts or activities that do not compromise the security of Personal Data, including unsuccessful log-in attempts, pings, port scans, denial of service attacks, or other network attacks on firewalls or networked systems. 

WePoll.Net will also reasonably cooperate with you to any investigations relating to a Security Incident, any required notices, and providing information reasonably requested by you and available to us in relation to any Security Incident, where such information is not already available to you in your account or online through updates provided by WePoll.Net.

4. Your Content

4.1 You Retain Ownership of Your Content.
In the path of using the Services, you may submit content to WePoll.Net (including your Personal Data and the Personal Data of others) or third parties may submit content to you through the Services (all of the above will be referred to as your “Content”). You retain ownership of all of your intellectual property rights in your Content. WePoll.Net does not claim ownership over any of your Content. These Terms do not grant us any licenses or rights to your Content except for the limited license described in these Terms.

4.2 Limited License to Your Content.
You provide WePoll.Net with a worldwide, royalty-free license to use, reproduce, distribute, modify, adapt, create derived works, make publicly available, and otherwise exploit your Content, but only for the limited purposes of providing and improving the Services and as permitted by the WePoll.Net privacy notices. 

Where permitted under applicable law, this license for such limited purposes continues even after you stop using our Services, to aggregate and de-identified data resulting from your Content and any residual backup copies of your Content made in the ordinary course of WePoll.Net's business (subject to our retention policies). This license also extends to any trusted third parties we work with to the extent necessary to provide and improve the Services.

4.3 Responsibility for Your Content
The Services may show content not owned by WePoll.Net but by others also. The company that makes such content available is responsible for it. WePoll.Net does not represent or warrant that it has reviewed such third-party content and/or the correctness of the information contained in such content. 

You are responsible for your Content, and you must ensure that you have all the rights and permissions needed to use that Content under the Services. WePoll.Net is not responsible for any actions you take to your Content, including sharing it publicly. Subject to applicable law, WePoll.Net is not liable for your Content, any other third-party content or materials, or any loss or damage resulting from your use of, or dependence on, such Content or other third-party content or materials.

You accept and agree that to ensure compliance with legal responsibilities and WePoll.Net's Acceptable Uses Policy, WePoll.Net may review the Content you submit to the Services to determine whether it is illegal or whether it intrudes upon these Terms (such as when unlawful content is reported to us). We may also, under applicable law, modify, prevent access to, delete or refuse to display your Content that we believe violates the law or these Terms. 

In the event your Content includes third-party brands, logos or other source identifiers, we may require you to submit a statement of non-affiliation before you may use such Content in connection with the Services. However, WePoll.Net otherwise has no compulsion to monitor or review any content submitted to the Services.

5. Third-Party Resources and Services
WePoll.Net may publish links on its websites maintained by third parties. WePoll.Net does not represent that it has reviewed such third-party websites and is not accountable for them or any content appearing on them. Trademarks displayed in agreement with the Services are the property of their respective owners.

WePoll.Net may provide you with access to, or enable third-party software, applications, products, services or website links (collectively, “Third-Party Services”) for your attention or use, including the Service and WePoll.Net’s website. Your purchase, access or use of any such Third-Party Services is exclusively between you and the applicable Third-Party Services provider (“Third-Party Provider”). 

In addition to these Terms Of Use, you agree to be assured by any additional terms and conditions applicable to services you purchase from, or that are provided by, Third-Party Providers. If you install or enable a Third-Party Service for use with the Service, you allow us permission to allow the applicable Third-Party Provider to access your Content and to take actions as required for the inter-operation of the Third-Party Service with the Service, and any exchange of your Content or other interaction between you and the Third-Party Provider is exclusively between you and such Third-Party Provider. We do not provide any warranties or make representations to you to Third-Party Services. Any use by you of Third-Party Services offered through the Service or WePoll.Net’s website is entirely at your own risk and decision, and the security of your Content is your responsibility. 

You are responsible for reading the terms and conditions and/or privacy policies applicable to such Third-Party Services before using them and ensuring such Third-Party Services meet your requirements or any legal or other requirements you may be subject to. You accept that WePoll.Net has no control over Third-Party Services and will not be responsible or liable to you or anyone else for such Third-Party Services, or for any transaction you may enter into with Third-Party, or for what the Third-Party Services do. 

WePoll.Net does not guarantee the availability of Third-Party Services and you concede that WePoll.Net may disable access to any such Services at any time, in its sole decision and without notice to you. WePoll.Net is not responsible or liable for the discontinuation or suspension of access to, or deactivation of, any Third-Party Service/s.

The Service includes features that can inter-operate with Third-Party Services, such as features that may enable you to collect payments from your end users.  We are not a party to, nor are we accountable, for such activities. You are solely responsible and responsible for such activities and complying with any laws or regulations related to it, including but not limited to, posting any legally required notices, terms, or policies.

6. Account Management

6.1 Keep Your Password Secure.
If you have created an account on WePoll.Net in connection with your use of the Services, you are responsible for the protection of your password and any other credentials used to access your account. You, and not WePoll.Net, are responsible for any activity occurring in your account (other than activity that WePoll.Net is directly responsible for which is not performed in agreement with your instructions), whether or not you authorized that activity. 

If you become aware of any unauthorized access to your account, you should notify us immediately. Accounts may not be shared and may only be used by one individual per account.

6.2 Keep Your Email and Account Details Accurate.
WePoll.Net sporadically sends notices to the email address registered with your account. You must keep your email address and, where applicable, your contact details associated with your account current and accurate. You are the authorization for the accuracy of your account details.

6.3 Account Inactivity.
WePoll.Net may close anyone’s account and delete any Content contained in it if there is no account activity (such as a log in event) for over 12 months. Where appropriate, we will attempt to warn you by email before closing your account due to idleness to provide you with an opportunity to log in to your account so that it remains active.

7. Suspension, Account Closure, and Termination of Services

7.1 By You
You (as an individual) can cancel your Subscription and/or close your account at any time over your account management page. When you close your account, your Subscription will automatically be cancelled, your Services will be terminated, and you will no longer be able to access your account to use the Services and your Content will be deleted under our data retention policy and the Terms Of Use. You can obtain a copy of your Content from the relevant Service(s) before closing your account, subject to applicable laws and policies. Alternatively, you can delete your Content yourself proactively before cancelling a Subscription and closing your account.

When you close your account, we will provide you with confirmation of account closure and Subscription termination, and you will not use your content again for that Subscription unless you open a new account. For clarity, we will not grant any guarantee where you have used our Services, collected responses, and/or downloaded your responses unless the termination is due to our material, untreated breach.

7.2 By WePoll.Net
WePoll.Net may cancel your Subscription and terminate the Services effective at any time.

WePoll.Net may limit, disable, suspend and/or cancel your Subscription and terminate the Services and/or close your account for any of the following reasons: 
(1) you have materially breached these Terms and failed to cure that breach within 30 days after WePoll.Net has so notified you; 
(2) you stop your business operations or become subject to insolvency proceedings and the proceedings; 
(3) you use the Services in a way that causes legal liability to us or disrupts others’ use of the Services; 
(4) if we are investigating suspected misconduct by you, including illegal activity; or 
(5) We are required as to do so to comply with applicable local laws. If we limit, disable, suspend and/or cancel your Subscription and/or terminate the 

Services, depending upon the reason, we will, where possible, try to attempt to give you advance notice and an opportunity to obtain a copy of your Content from that Service. However, there may be time-sensitive situations where WePoll.Net may decide that we need to take immediate action without notice. 

WePoll.Net will use commercially reasonable efforts to narrow the scope and duration of any limitation or suspension under this Section as is needed to resolve the issue that prompted such action. Except as set out in our Privacy Notice, and as may be required under applicable law, WePoll.Net has no responsibility to retain your Content upon closure of your account.

8. Changes and Updates

8.1 Changes to Terms.
WePoll.Net may change these Terms at any time for various reasons, such as to reflect changes applicable to local law or updates to Services and to account for new Services or functionality, for security or to prevent misuse, abuse or harm. The most current version will always be posted on the WePoll.Net website. 

If a modification is material, WePoll.Net will notify you in advance by email to provide you the opportunity to review the changes. Notice of adjustments may also be posted upon your login to your account. Except as otherwise specified by us, changes will be effective no sooner than the day they are publicly posted. 

Once our new terms are effective, if you continue to use the Services, you indicate your agreement to be bound by the updated terms. If you do not agree to any changes made to the terms of a Service, you should stop using that Service and you may close your account with us under the above.
